01 टूल की प्रकृति एवं सीमित भूमिका (Nature of the Platform as a Tool)

PressIDCard.in को विशेष रूप से एक तकनीकी साधन (Software-as-a-Service) के रूप में डिज़ाइन किया गया है। वेबसाइट के मालिक, डेवलपर्स एवं संचालक किसी भी प्रकार की पत्रकारिता प्रमाणन संस्था (Accrediting Authority) नहीं हैं। हमारा कार्य केवल खाली डिजिटल कैनवास/टेंप्लेट और डेटाबेस प्रबंधन प्रदान करना है।

जब कोई मीडिया चैनल अपना RNI पंजीकरण, MSME/उद्यम प्रमाण पत्र, पता, नाम और लोगो अपलोड करता है, तो हमारा सिस्टम केवल उस इनपुट के अनुसार एक रेडी-टू-प्रिंट आईडी कार्ड फॉर्मेट जनरेट करता है। सिस्टम द्वारा किसी कार्ड का निर्माण होना यह सिद्ध नहीं करता कि वह व्यक्ति शासन या कानून द्वारा मान्यता प्राप्त पत्रकार है।

02 चैनल/मीडिया हाउस की पूर्ण एवं अंतिम जिम्मेदारी (Sole Responsibility of Media House)

इस टूल का उपयोग करने वाले प्रत्येक मीडिया चैनल/ऑनर की यह कानूनी और नैतिक बाध्यता है कि:

• वे केवल उन्हीं व्यक्तियों का आईडी कार्ड जनरेट करें जो वास्तव में उनके संस्थान में पत्रकार, रिपोर्टर या कर्मचारी के रूप में कार्यरत हैं।
• संस्थान द्वारा अपलोड किए गए RNI प्रमाण पत्र, MSME/उद्यम नंबर, अधिकृत हस्ताक्षर और स्टैम्प 100% असली, वैध और सरकारी रिकॉर्ड के अनुसार होने चाहिए।
• यदि कोई मीडिया हाउस किसी गैर-पत्रकार, आपराधिक प्रवृत्ति वाले व्यक्ति या बाहरी व्यक्ति का प्रेस आईडी कार्ड बनाता है, तो उसकी पूर्ण व्यक्तिगत व कानूनी जिम्मेदारी केवल और केवल उस चैनल मालिक की होगी।
• किसी भी रिपोर्टर के संस्थान छोड़ने पर चैनल एडमिन की जिम्मेदारी है कि वह तुरंत हमारे पोर्टल से उस रिपोर्टर के कार्ड को निष्क्रिय (Deactivate) करे।

03 व्यक्तियों/यूजर्स द्वारा गलतफहमी एवं गैरकानूनी उपयोग की रोकथाम

कई व्यक्ति इस गलतफहमी में रहते हैं कि पोर्टल पर खुद को रजिस्टर कर लेने से उन्हें "प्रेस कार्ड" की पात्रता मिल जाती है। हम स्पष्ट रूप से रेखांकित करते हैं:

• बिना वैध मीडिया संस्थान के प्रेस आईडी कार्ड का उपयोग गैरकानूनी है: मोटर वाहन पर अनधिकृत "PRESS" लिखना, टोल प्लाजा, पुलिस नाकों या प्रशासनिक जांच में फर्जी प्रेस कार्ड दिखाना भारतीय कानून (IPC / BNS एवं Motor Vehicles Act) के तहत दंडनीय अपराध है।
• कोई भी व्यक्ति हमारे टूल से बने किसी प्रिंटआउट को सरकारी पहचान पत्र या अधिमान्यता (Accreditation) के रूप में प्रस्तुत नहीं कर सकता।
• गलत पहचान बनाना, प्रतिरूपण (Impersonation - IPC धारा 419) या कूट-रचना (Forgery - IPC धारा 465/468) करने वाले किसी भी व्यक्ति के खिलाफ कानूनन सख्त कार्यवाही हो सकती है।

04 वेबसाइट ओनर का कानूनी सुरक्षा कवच (Safe Harbor & Liability Protection)

सूचना प्रौद्योगिकी अधिनियम, 2000 (Information Technology Act, 2000) की धारा 79 (Section 79) के तहत PressIDCard.in एक "मध्यस्थ" (Intermediary/Technology Platform) है:

1. शून्य दायित्व (Zero Liability for Platform Owner): किसी भी यूजर या चैनल द्वारा अपलोड किए गए डेटा, नाम, तस्वीर, फर्जी दस्तावेज या अनधिकृत कार्ड जनरेशन के लिए वेबसाइट ओनर, फाउंडर या टेक्निकल टीम किसी भी दीवानी (Civil) या फौजदारी (Criminal) मुकदमे, जुर्माने या क्षतिपूर्ति के लिए उत्तरदायी नहीं होंगे।
2. पूर्ण क्षतिपूर्ति (Indemnification): इस प्लेटफॉर्म का उपयोग करने वाला प्रत्येक यूजर/चैनल यह स्वीकार करता है कि यदि उसके किसी कार्य, कार्ड जनरेशन या दुरुपयोग से वेबसाइट ओनर पर कोई कानूनी नोटिस, पुलिस जांच या दावा आता है, तो यूजर वेबसाइट ओनर को सभी कानूनी खर्चों व हरजाने सहित पूर्ण रूप से सुरक्षित (Indemnify) रखेगा।
3. कानून प्रवर्तन एजेंसियों को सहयोग: किसी भी संदिग्ध, फर्जी या असामाजिक गतिविधि की सूचना मिलने पर हम बिना पूर्व सूचना के यूजर का अकाउंट बंद कर देंगे तथा पुलिस व जांच एजेंसियों (Cyber Cell, Police, Ministry) को आवश्यक डिजिटल लॉग्स एवं आईपी डेटा सौंपने के लिए बाध्य होंगे।

05 रिपोर्टर आवेदन एवं सत्यापन अस्वीकरण

प्लेटफॉर्म पर दिए गए 'Reporter Application Form' के माध्यम से जो भी व्यक्ति आवेदन करता है, उसका चयन केवल संबंधित चैनल के एडमिन के अनुमोदन (Approval) पर निर्भर करता है। PressIDCard.in किसी भी रिपोर्टर की पृष्ठभूमि जांच (Background Check), पुलिस सत्यापन या चरित्र प्रमाणन नहीं करता।

01 Nature of Service: Technological Tool Only

PressIDCard.in provides software infrastructure for media publishers to organize their team data and render printable ID cards, authorization letters, and visiting card layouts. The platform owners and developers do not act as an accreditation council, licensing body, or government authority.

When a media house uploads its registration credentials (such as RNI registration certificates, MSME/Udyam certificates, editorial signatures, and seals), our software compiles those data inputs into standard print formats. The resulting document is strictly an internal organizational card format of that specific media house and does NOT constitute any statutory recognition from this platform.

02 Media House Sole Legal Responsibility

All legal, statutory, and regulatory liability regarding the issuance of credentials lies solely with the registered Media House (Channel Owner). By utilizing our generator tools, the Media House explicitly agrees that:

• It possesses genuine, valid, and legally recognized registration (e.g., RNI certificate, MSME Udyam registration, or statutory registration as a digital publisher).
• It shall ONLY issue credentials to bona fide staff, employees, or contracted reporters who have undergone appropriate background verification.
• It shall never issue credentials to third parties for money, favor, or deceptive practices.
• It shall immediately revoke and deactivate any credential in the portal whenever a reporter's affiliation is terminated.

03 Prohibition of Misrepresentation & Illegal Use

Using a press identification to evade toll charges, intimidate public servants, mislead law enforcement, or commit extortion is a severe criminal offense under the Bharatiya Nyaya Sanhita (BNS) / Indian Penal Code (IPC Sections 419, 420, 465, 468, 471) and the Motor Vehicles Act.

• Possession of an ID card rendered via this tool does NOT grant exemption from traffic regulations, police verification, or standard laws of the land.
• Any person misrepresenting this platform's digital layout as a government press badge does so at their own criminal risk.

04 Protection of Website Owners (Safe Harbor & Indemnity)

Pursuant to Section 79 of the Information Technology Act, 2000 (Intermediary Guidelines and Digital Media Ethics Code):

1. Exemption from Liability: The website owners, creators, hosting providers, and operators of PressIDCard.in shall not be held liable for any third-party information, data, fraudulent documents, or unauthorized ID cards generated through this automated tool.
2. Full Indemnification: Each channel administrator and user agrees to defend, indemnify, and hold harmless PressIDCard.in, its founders, and affiliates from all claims, damages, liabilities, police inquiries, and legal fees arising from the creation, printing, or misuse of credentials.
3. Immediate Account Termination & Legal Cooperation: We reserve the absolute right to suspend or delete any channel account found to be engaging in unauthorized card issuance, forgery, or fraudulent activity, and will cooperate fully with state police, cyber crime cells, and judicial authorities.

05 No Background Verification of Applicants

The online application forms provided for reporters are merely a convenient digital collection mechanism for media channels. PressIDCard.in does NOT conduct criminal record checks, identity verification, or journalist competency testing on any applicant. The final approval and vetting remain 100% the duty of the respective channel.
