01 शर्तों की स्वीकृति (Acceptance of Terms)

PressIDCard.in का उपयोग करने, पंजीकरण करने अथवा किसी भी आईडी कार्ड फॉर्मेट को जनरेट करने से पूर्व आप इन नियमों व शर्तों को स्वीकार करते हैं। यदि आप किसी मीडिया चैनल या समाचार पत्र के प्रतिनिधि के रूप में पंजीकरण कर रहे हैं, तो आप प्रमाणित करते हैं कि आपको उस संस्थान की ओर से कानूनी निर्णय लेने का पूर्ण अधिकार प्राप्त है।

02 सेवा का स्वरूप: केवल सॉफ्टवेयर टूल (Nature of Software Tool)

PressIDCard.in मीडिया संस्थानों को आंतरिक पहचान पत्र प्रबंधन के लिए केवल तकनीकी साधन उपलब्ध कराता है:

• मीडिया चैनल द्वारा उपलब्ध कराए गए नाम, पद, फोटो, पते तथा संस्थागत विवरण को डिजिटल कार्ड लेआउट में व्यवस्थित करना।
• आंतरिक वेरिफिकेशन के लिए डायनामिक QR कोड तैयार करना।
• चैनल द्वारा अपलोड किए गए RNI पंजीकरण या MSME / उद्यम प्रमाण पत्र के आधार पर टेम्पलेट तैयार करना।
• महत्वपूर्ण: वेबसाइट संचालक किसी भी व्यक्ति के पत्रकार होने या न होने की जांच, प्रमाणन अथवा गारंटी नहीं देते हैं।

03 चैनल / मीडिया हाउस की पूर्ण जवाबदेही (Sole Liability of Media House)

आईडी कार्ड जारी करने, प्रिंट करने और किसी व्यक्ति को सौंपने की शत-प्रतिशत कानूनी और नैतिक जिम्मेदारी केवल और केवल संबंधित मीडिया चैनल की है:

• चैनल केवल अपने वास्तविक और अधिकृत कर्मियों/रिपोर्टरों का ही कार्ड तैयार करेगा।
• किसी भी गैर-पत्रकार या तीसरे व्यक्ति का प्रेस कार्ड बनाना अथवा अवैध लाभ के लिए कार्ड बेचना/जारी करना सख्त वर्जित है।
• यदि कोई चैनल फर्जी या अमान्य RNI/MSME दस्तावेज अपलोड करता है, तो उसके विरुद्ध भारतीय कानून (IPC/BNS) के तहत धोखाधड़ी का मामला दर्ज होगा, जिसके लिए चैनल मालिक स्वयं व्यक्तिगत रूप से उत्तरदायी होगा।
• किसी भी रिपोर्टर का कार्यकाल समाप्त होने पर चैनल तुरंत उसका कार्ड हमारे सिस्टम में डिएक्टिवेट करेगा।

04 वेबसाइट मालिक का दायित्व मुक्ति कवच (Intermediary Safe Harbor & Indemnity)

सूचना प्रौद्योगिकी अधिनियम, 2000 (IT Act 2000) की धारा 79 के तहत PressIDCard.in एक तकनीकी मध्यस्थ (Intermediary) है:

1. शून्य दायित्व (Zero Liability): यूजर्स अथवा चैनलों द्वारा अपलोड किए गए किसी भी डेटा, फर्जी कागजात, नकली कार्ड जनरेशन, अवैध पत्रकारिता, टोल टैक्स चोरी या ब्लैकमेलिंग के किसी भी मामले में वेबसाइट मालिक, फाउंडर, डेवलपर या सर्वर प्रोवाइडर किसी भी रूप में जिम्मेदार नहीं होंगे।
2. क्षतिपूर्ति अनुबंध (Indemnification): चैनल मालिक और यूजर यह स्वीकार करते हैं कि उनके द्वारा टूल के दुरुपयोग के कारण यदि वेबसाइट मालिक के विरुद्ध कोई पुलिस शिकायत, अदालती नोटिस या वित्तीय नुकसान होता है, तो उसकी पूरी भरपाई (समेत कानूनी फीस) संबंधित यूजर/चैनल द्वारा की जाएगी।
3. कानूनी सहयोग: साइबर सेल, पुलिस प्रशासन अथवा न्यायालय द्वारा किसी संदिग्ध कार्ड या चैनल के संबंध में जानकारी मांगे जाने पर हम पूर्ण डिजिटल लॉग्स और आईपी डिटेल्स साझा करने के लिए बाध्य हैं।

05 प्रतिबंधित गतिविधियां (Prohibited Activities)

प्लेटफॉर्म पर निम्नलिखित गतिविधियां पूर्णतः निषिद्ध हैं:

• सरकारी अधिकारी, पीआईबी (PIB) या राज्य जनसंपर्क विभाग का फर्जी प्रेस कार्ड बनाना।
• फर्जी या किसी दूसरे व्यक्ति के पहचान पत्र (Aadhaar / Voter ID) का उपयोग करना।
• QR कोड वेरिफिकेशन सिस्टम या सर्वर की सुरक्षा के साथ छेड़छाड़ करना।
• इस टूल से बने कार्ड का उपयोग करके किसी को धमकाना, ब्लैकमेल करना या अवैध टोल छूट मांगना।

06 भुगतान एवं सदस्यता (Payments & Subscriptions)

सॉफ्टवेयर टूल्स एवं क्लाउड सुविधाओं के उपयोग के लिए निर्धारित शुल्क लिया जाता है। सभी भुगतान सुरक्षित गेटवे (Razorpay) द्वारा संसाधित होते हैं। सदस्यता शुल्क सॉफ्टवेयर के उपयोग हेतु है, न कि किसी प्रेस अधिकार को खरीदने के लिए।

07 खाता निरस्तीकरण (Suspension & Termination)

यदि किसी चैनल या यूजर द्वारा फर्जीवाड़े, जाली दस्तावेजों या गैरकानूनी गतिविधि की शिकायत प्राप्त होती है, तो उसका अकाउंट बिना किसी अग्रिम सूचना या रिफंड के तत्काल स्थायी रूप से बंद कर दिया जाएगा।

01 Acceptance of Terms

By creating an account, registering a media channel, or generating any document on PressIDCard.in, you agree to be legally bound by these Terms and Conditions. If you represent an organization or publication, you warrant that you hold legitimate authority to bind that entity to this agreement.

02 Description of Service: Software Platform

PressIDCard.in provides a cloud-based document layout and reporter database management software (SaaS) enabling organizations to:

• Organize internal reporter applications and record directories.
• Render standardized graphic print layouts for press ID cards, authorization letters, and visiting cards.
• Maintain dynamic QR codes for internal channel lookup and validation.
• Notice: The platform does not inspect the journalistic competence or verify the accreditation status of any cardholder.

03 User & Media House Obligations

The Media House (Channel Administrator) holds sole and exclusive legal accountability for every credential generated under its account:

• The Media House must ensure all registration details (RNI, MSME, Udyam) provided are authentic and in current legal force.
• Credentials may ONLY be generated for active, bona fide journalists and employees of that specific news organization.
• Sale of press ID cards to non-journalists or the public is strictly prohibited and constitutes criminal forgery.
• Upon termination of an individual's association, the channel must immediately revoke the credential in the system.

04 Safe Harbor, Intermediary Status & Complete Indemnification

Under Section 79 of the Information Technology Act, 2000:

1. Platform Immunity: PressIDCard.in operates as an automated intermediary. The website owners, founders, and infrastructure providers are NOT liable for any fraudulent documents, false claims, misrepresentation, or crimes committed with cards generated through the tool.
2. Indemnity Obligation: Users agree to defend, indemnify, and hold harmless PressIDCard.in against any claims, police complaints, criminal proceedings, damages, or legal expenses resulting from the use or misuse of the generated credentials.
3. Law Enforcement Assistance: We reserve the right to furnish all technical records, IP addresses, and upload logs to police authorities and cybersecurity regulators in investigations involving impersonation or fraudulent identity.

05 Prohibited Conduct

Users shall not under any circumstances:

• Impersonate government bodies, statutory press councils, or police authorities.
• Generate credentials using fraudulent, fabricated, or forged RNI or MSME certificates.
• Utilize generated cards to evade toll charges, threaten citizens, or demand illegal favors.
• Attempt to tamper with the system's dynamic QR code verification architecture.

06 Payments and Subscriptions

Service plans provide software access, cloud hosting, and generation credits. Payments are billed via Razorpay and are non-refundable once software services and card generation quotas are availed.

07 Account Termination

We reserve the unilateral right to suspend, terminate, or black-list any account that breaches these terms or causes legal jeopardy to the integrity of the platform.
